Agreement
By engaging Via Nova Digital to carry out work for your business, you agree to be bound by these Terms & Conditions. These terms apply to all projects and services unless otherwise agreed in writing.
Quotes & Pricing
All quotes provided by Via Nova Digital are valid for 30 days from the date of issue. Accepted quotes become fixed-price agreements unless variations are requested by the client and agreed in writing. Any variation to the original scope will be priced and presented before work commences.
Payment Terms
Payment terms are outlined in your project quote. Standard terms require a deposit upon acceptance, a progress payment at an agreed milestone, and a final payment upon satisfactory completion. All invoices are due within 7 days of issue.
Intellectual Property
Upon receipt of final payment, all deliverables produced for your project become your property. Via Nova Digital retains the right to display completed work in its portfolio unless otherwise agreed in writing.
Warranties
Via Nova Digital guarantees all development work for 30 days from project handover. Bugs or issues arising from our work will be fixed at no charge within this period. This warranty does not cover changes made by the client or third parties.
Limitation of Liability
Our liability under these terms is limited to the value of the project contract. Via Nova Digital is not liable for any indirect, consequential, or incidental loss arising from our work, except where liability cannot be excluded by Australian law.
Confidentiality
Both parties agree to keep confidential any sensitive information shared during the engagement. This includes business data, pricing, and any proprietary information disclosed for the purpose of the project.
Dispute Resolution
In the event of a dispute, both parties agree to first attempt resolution by direct negotiation. If unresolved, either party may refer the matter to NSW Fair Trading or the NSW Civil and Administrative Tribunal (NCAT) as appropriate.
Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia.
